- A federal judge ordered HHS to create a plan to correct underpayments made to 340B hospitals. The department cut 340B reimbursement by nearly 30 percent in 2018 and redistributed the $1.6 billion in savings to all hospitals. In June, the Supreme Court ruled that HHS lacked the legal authority to implement its changes to the 340B program without determining what hospitals pay for outpatient drugs. HHS proposed reimbursing for 340B drugs at the same rate as other medicines, but the American Hospital asked the court to vacate the rules and to dictate terms to the department. (Article here)
