- The Supreme Court is set to hear arguments tomorrow in a case seeking to reverse cuts to the 340B Drug Program. The plaintiffs contend that if the court allows the rule to stand, “340B providers will be forced to eliminate or dramatically curtail some crucial programs that treat a wide range of medical conditions, from cancer to mental health disorders and opioid addiction.” If the Supreme Court rules for the hospitals, they may be retroactively reimbursed to make up for the lower payments they received during the two year the cuts were in force. An appeals court concluded last year that judicial review isn’t precluded, but sided with HHS on the case itself after a lower court ruled for the plaintiffs in 2019. (Article here)
