- The Centers for Medicare & Medicaid Services (CMS) sent Texas a notice that it will no longer revoke the state’s decade-long uncompensated care waiver extension. CMS approved the Texas waiver, which authorizes the state to give out more than $3.8 billion to providers to account for uncompensated care alone, in 2011. The Trump administration approved the state’s third extension in January 2021; however, the Biden administration last April informed Texas it would revoke the extension. Friday’s notice stated that, “CMS has concluded that it is not the best use of the federal government’s limited resources to continue to litigate this matter” and that the agency remains committed to working with states to conduct robust notice and comment periods on all Medicaid waivers, in accordance with federal requirements.
